Liability Waiver Form for Turkey Creek Ranch (TCR)
In consideration for receiving permission from TCR to use their facilities and equipment to participate in equine activities such as, but not limited to, horseback / pony riding, stagecoach rides, hayrides, express wagon rides, I agree for myself, my heirs, assigns, executors, administrators, personal representatives, and derivative claimants, that my use of any TCR facilities, equipment, or participation in equine activities shall be undertaken at my own risk and that the TCR, the 7th Infantry Division, and Fort Carson , the Department of the Army, the government of the United State, and its officers, agents, and employees whether acting officially or otherwise, shall not be liable for any claims, demands, injuries, damages, actions, or causes of action which arise wholly or partially due to the negligence of the entities above, or arising out of or in connection with my use of TCR facilities, equipment, or participation in equine activities.
I understand there are risks and dangers inherent in the use of TCR facilities, equipment, or participation in equine activities. I am aware that equine activities such as but not limited to horseback / pony riding, stagecoach rides, hayrides, express wagon rides, and the use of equipment related to these activities, can be hazardous and involve inherent and other risks of personal injury, property damage, and death. I understand and agree that by signing this release I am assuming full responsibility for any and or all risks of death or personal injury or property damage suffered by me while at or using TCR facilities and equipment.
I understand and agree that by signing this release, I am to release, indemnify, and hold harmless the TCR, the 7th Infantry Division, and Fort Carson, the Department of the Army, the government of the United State, and its officers, agents, and employees, whether acting officially or otherwise, from any and all liability or costs, including attorney fees, associated with or arising from my use of TCR facilities, equipment, or participation in equine activities.

The information requested above is solicited under the authority of 5 U.S.VC. 552a and 10 U.S.C. 3012 and will be used to ensure correct identification to verify participation, and to determine responsibility in the event of accident, loss, injury, or death. It may be routinely provided to other government agencies when necessary to resolve claims for or against the United States and to private insurance companies if necessary for these purposes. Disclosure of the information requested is voluntary: failure to provide this information will result in denial of the request to use TCR facilities, equipment, or participation in an equine activity.

Under Colorado law, an equine professional is not liable for an injury to or the death of a participant in equine activities from the inherent risks of equine activities, pursuant to section 13-21-119, Colorado Revised Statutes.
